CC&R's - Declaration of Covenants, Conditions, and Restrictions
The phrase “CC&R’s” is common vernacular for San Francisco homeowners. As condominium ownership and condo conversion are increasingly more attractive, the phrase “What do your CC&R’s say?” tends to come up frequently.
A CC&R is the declaration of covenants, conditions, and restrictions that govern a condominium or planned development and is required of all condominiums. Once completed, they are recorded with the county and become a part of public record. Each CC&R is different depending on the owners and the properties involved. Generally the CC&R’s will define:
- Boundaries of each unit or lot and definition of common areas.
- Responsibilities and processes required of each owner regarding financial matters such as fee collection and spending, mortgage lending, and insurance.
- Protocol for property usage, building rules and regulations, and communication and resolution of problems and disputes.
